1. AGREEMENT TO TERMS

These Terms of Service ("Terms") govern your use of the website fieldassistants.com (the "Site") and any services offered by JJ Legacy Ventures LLC, doing business as Field Assistants ("JJ Legacy", "we", "us", or "our"). By accessing the Site, requesting a Lead-Capture Snapshot, contacting us, or engaging us for services, you agree to these Terms.

If you do not agree, do not use the Site.

2. DESCRIPTION OF SERVICE

Field Assistants provides lead-capture and marketing-automation services to home-service contractors (HVAC, plumbing, landscaping, electrical, and adjacent verticals). Our services include, but are not limited to:

- Configuration of CRM and automation workflows on the GoHighLevel platform

- SMS and email follow-up sequences

- Phone-number provisioning and missed-call automation

- Reputation-management workflows (Google review generation)

- Customer-base reactivation campaigns

- Free Lead-Capture Snapshot reports

The specific scope of services for any client is defined in a separate signed Service Agreement.

3. ELIGIBILITY

You must be at least 18 years old and legally able to enter into a binding contract to use our services. By using the Site, you represent and warrant that you meet these requirements.

4. USE OF THE SITE

You agree not to:

- Use the Site for any unlawful purpose

- Attempt to gain unauthorized access to any portion of the Site or our systems

- Interfere with or disrupt the Site, our servers, or the networks connected to the Site

- Use any automated means (bots, scrapers, etc.) to access the Site without our written permission

- Submit false or misleading information through any form on the Site

- Use the Site to send spam, harass, or harm others

5. FREE LEAD-CAPTURE SNAPSHOT

The Lead-Capture Snapshot we provide on request is a complimentary preliminary assessment. It is generated using publicly available information from Google Places and similar sources, combined with industry benchmarks. It is intended as a conversation starter, not a CPA-grade audit. Estimated revenue figures, missed-call estimates, and competitor comparisons are illustrative. Actual business outcomes depend on many factors outside our control. We make no warranty regarding the accuracy or completeness of any snapshot.

6. ENGAGEMENT AND SERVICE AGREEMENTS

Engaging us as a paid client is governed by a separate signed Service Agreement that includes the specific scope, fees, payment terms, and term length. The terms of any Service Agreement supersede these Terms to the extent of any conflict.

7. INTELLECTUAL PROPERTY

The Site, the Lead-Capture Snapshot tool, our workflows, our written materials, and any software we develop in the course of providing services are owned by JJ Legacy or our licensors. You may not copy, modify, distribute, or create derivative works of any of our intellectual property without written permission.

Customer data you provide to us as part of a paid engagement remains your property. We will not use it for any purpose other than delivering the services you contracted for.

8. PAYMENT TERMS (FOR PAID CLIENTS)

If you become a paid client, payment terms are governed by your Service Agreement. Generally:

- Setup fees are due in full upon signing the Service Agreement and before work begins.

- Monthly retainer fees are billed in advance on the same date each month.

- Failure to pay may result in suspension of services after 10 days past due.

Refund policies are described in your Service Agreement.

9. CANCELLATION

For paid client services, cancellation terms are governed by your Service Agreement. Generally:

- Standard tier services are month-to-month after the initial 30-day setup period.

- Founder's Rate services have a 6-month minimum commitment.

- Upon cancellation, we will export your customer data to you within 14 days and shut down the workflows configured under your account.

10. DISCLAIMERS

THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee any specific business outcome from using our services. Results depend on factors including but not limited to your operational execution, market conditions, customer behavior, and the quality of leads entering your business. Industry benchmarks we cite are documented but represent statistical averages, not guarantees.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JJ LEGACY VENTURES LLC AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SITE OR OUR SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. INDEMNIFICATION

You agree to indemnify and hold harmless JJ Legacy Ventures LLC, its owners, and its agents from any claims, damages, losses, or expenses arising out of:

- Your violation of these Terms

- Your violation of any applicable law or regulation

- Information you provide to us (including SMS opt-in lists you upload, customer data, etc.) that you did not have proper consent to share

13. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or our services shall be resolved through binding arbitration in Gwinnett County, Georgia, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property infringement or breach of confidentiality.

14. CHANGES TO THESE TERMS

We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent change. Continued use of the Site after changes constitutes acceptance.
